A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant entered a female toilet for the purpose of meeting his own sexual desire, and had a mind to photograph the appearance of women’s appearance.

1. Crimes committed on May 6, 2020;

A. A. On May 6, 2020, the Defendant, in violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Intrusion into public use places for sexual purposes), entered into a female toilet with the fourth floor of C University D Center, located in Jinju-si B, in order to report the victim E (if known, 33 years old) entering the victim’s toilet, and to take a image of the victim’s appearance, etc., he/she entered the victim’s toilet.

Accordingly, the defendant invadeds on public use places such as toilets with a view to meeting his sexual desire.

B. The Defendant, in violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (such as Cameras, etc.), took pictures of the victim’s appearance, which is included in the toilet screen, in which the victim’s cellular phone owned by the Defendant is located, in the time and place set forth in paragraph (1) of Article 1, and is deemed to have exceeded the Defendant’

As a result, the defendant took photographs of the body of the victim who could cause sexual humiliation or shame by using a camera or other similar mechanism.

2. Crimes committed on July 9, 2020;

A. A. On July 9, 2020, the Defendant violated the Act on the Punishment, etc. of Sexual Crimes (Intrusion into a public use place for sexual purposes) entered into a female toilet according to the victim to take a photograph of the victim’s appearance, etc., by reporting the victim’s entry into a female toilet at around 09:46 (a) around 1, 2020.

Accordingly, the defendant invadeds on public use places such as toilets with a view to meeting his sexual desire.

B. The accused is in violation of the Act on the Punishment, etc. of Sexual Crimes (Kameras, etc.) and toilets in which the victimized person enters his/her mobile phone at the time and place set forth in paragraph (2).
