피고인은 2014. 6. 17. 23:46경부터 같은 날 23:57경까지 목포시 C에 있는 '목포경찰서 D파출소'에서, 술값을 계산하지 않아 무전취식으로 임의동행 되어 와 경찰관이 사건 개요를 설명한 후 인적사항을 물으면서 신분증을 제시하여 달라고 하자 신분증을 제시하지 않은 채 고함을 지르고, 술에 취한 상태에서 “뭐 어쩌자고, 거지 새끼들아, 알고 있잖아, 내가 벌금 냈잖아 새끼들아, 거지 새끼들아, 양아치 새끼들아”라고 욕설을 하며 들고 있던 핸드폰을 바닥에 던지고, 계속해서 경위 E을 양손으로 밀치며 “밥을 먹고 산다, 야 있다고 새끼들아, 당신 뭐여 거지 양아치 새끼들, 모지란 소리 하지 마, 이 시팔 놈들아, 야 씨발 놈아 왜”라고 욕설을 하는 등 술에 취한 채로 관공서에서 거친 말과 행동으로 시끄럽게 하였다.
