1. Basic facts

A. On November 4, 2008, the Plaintiff entered into an injury insurance contract between the Defendant and the Plaintiff (hereinafter “instant insurance contract”) whereby the beneficiary is the Plaintiff upon the death of the insured Party B and the beneficiary.

Article 13 (Types and Grounds for Payment of Insurance Money) (1) A communications agency shall pay insurance money agreed upon to a beneficiary of insurance (beneficiary of insurance) when any of the following events occurs to a beneficiary of insurance during the period of insurance:

5. Insurance proceeds of ordinary daily death: Article 18 (Insurance Accidents for which no Insurance Money is to be paid) (1) When any cause for the payment of insurance proceeds occurs due to any of the following cases, a communications agency may terminate this contract simultaneously with the failure to pay insurance proceeds or exempt the payment of insurance premiums.

1. Where an insured person intentionally damages himself/herself: Provided, That this shall not apply where it is proved that he/she has impaired himself/herself in a state that the insured person is unable to make a free decision due to mental illness, etc.;

1. Any of the following disasters subject to coverage shall be paid insurance proceeds in accordance with the terms and conditions of this insurance:

(1) Any contingent external accident falling under the Korean Standard Disease and Death Classification (S0-Y84).

2. Where an accident for which insurance proceeds are not paid falls under any of the following subparagraphs, insurance proceeds shall not be paid after being excluded from the Disaster Classification:
