No one shall engage in speculative activities as a business by using slot machines or speculative gaming machines, other than speculative business.

피고인은 2016. 8. 10. 경부터 2016. 8. 25. 경까지 사이에 거제시 B 지하 1 층에 있는 상호가 없는 게임 장에서, 게임 물관리 위원회로부터 등급 분류가 거부된 사행성 전자식 유기기 구인 야마 토 게임기 11대, 물고기 게임기 1대, 은하 철도 게임기 1대, 루 팡 게임기 1대, 7 인의 사무라이 게임기 1대, 스파이 더 맨 게임기 1대 등 총 16대의 게임기를 설치하여 위 게임 장을 방문하는 불특정 다수의 손님들 로 하여금 위 게임기에 현금을 투입하게 한 후, 시작 버튼을 눌러 베팅을 하게 하여 화면 상의 그림이나 숫자가 돌아가다가 멈췄을 때 그림이나 숫자의 가로, 세로, 대각선의 배열이 일정한 규칙에 따라 일치되면 점수를 획득케 하여, 1점 당 5,000원으로 환산해 환전 수수료 10%를 제외한 나머지 4,500원을 환전해 주는 방법으로 사행행위를 업으로 하였다.
