1. The defendant shall pay to the plaintiff KRW 21,368,482 and interest rate of KRW 19% per annum from June 30, 2004 to the day of complete payment.
Reasons
1. Indication of claim;
A. The Plaintiff filed an application against the Defendant for the payment order with the Changwon District Court Jinwon Branch Branch of 2005 tea5389, and on October 17, 2005, the Plaintiff ordered the Defendant to pay “the Defendant shall pay to the Plaintiff 21,368,482 won and the amount calculated at the rate of 19% per annum from June 30, 2004 to the date of full payment.” The above payment order was served on the Defendant on October 28, 2005, and became final and conclusive on November 12, 2005.
B. The Plaintiff filed the instant lawsuit for the extension of extinctive prescription of the above payment order.
2. Judgment by service (Article 208 (3) 3 of the Civil Procedure Act).
