1. The defendant A shall be punished by imprisonment with prison labor for ten months.

However, the above sentence shall be executed for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

Defendant

A is the representative director of the industrial chain B, and Defendant B is a corporation established for the purpose of the island milk processing business.

1. Defendant A

(a) No business operator who installs measuring devices, such as measuring devices, operating wastewater, and flow meters, shall perform any act to prevent any normal measurement from being performed when he/she operates such measuring devices;

피고인은 2017. 11. 8. 경 위 주식회사 B에 설치된 폐수처리장에서 폐수적 산유량계의 전원을 수시로 차단하여 현재 배출되는 폐수의 유량을 인식되지 아니하는 상태로 운용한 것을 비롯하여, 2017. 9. 초순경부터 2017. 11. 8. 경까지 허가 받은 하루 폐수 배출량 189㎥ 이상으로 적산되지 않도록 하기 위하여 폐수적 산유량계의 전원을 껐다 켰다를 반복하여 가동시간을 줄이는 방법으로 정상적인 측정이 이루어지지 아니하도록 하였다.

(b) Where a person who has obtained permission for discharge facilities of wastewater with unpaid wastewater intends to change the permissible discharge quantity of wastewater not less than 50/100, he shall obtain permission for change from the competent authorities; and

The Defendant did not obtain permission for change from the competent authority, and discharged wastewater from the early September 2017 to November 8, 2017, in excess of 189 square meters per day permitted at the above place, and discharged wastewater from 686.8 cubic meters per day.

(c)

Any person who intends to install an unauthorized emission facility or to operate a business using such emission facility shall obtain permission from the competent authorities.

From September 2017 to November 8, 2017, the Defendant, without obtaining permission from the competent authorities, used a total of seven emission facilities, including a high-tension 700 km 5 g and 400 km, which is a fiber and processing facility, in the foregoing place.

2. The defendant B is the date and time set forth in paragraph (1) in relation to the defendant's business, who is the representative director.
