피고인들은 공모하여, 2017. 11. 16. 경 D 공동 처리장에서 폐수적 산유량계의 전원을 차단하여 현재 배출되는 폐수의 유량이 전혀 인식되지 아니하는 상태로 폐수적 산유량계를 운용한 것을 비롯하여, 2016. 5. 13. 경부터 2017. 11. 16. 경까지 허가 받은 하루 폐수 배출량 86㎥ 이상으로 적산되지 않도록 하기 위하여, 폐수적 산유량계의 전원을 껐다 켰다를 반복하여 가동시간을 줄이고, 가동 중인 경우에도 실제 유량의 절반 이하로 인식되는 상태로 폐수적 산유량계를 가동하는 방법으로 정상적인 측정이 이루어지지 아니하도록 하였다.

2. Where a person who has obtained permission to discharge wastewater in excess of the permitted discharge quantity of wastewater intends to change the permitted discharge quantity of wastewater in excess of 50/100, he shall obtain permission for the change from the competent authorities.

The Defendants conspired to obtain permission from the competent authorities without obtaining permission for change from May 13, 2016 to November 16, 2017, and discharged wastewater from a maximum of 242 cubic meters per day in excess of 86 cubic meters per day permitted at the same place.
