For the reasons indicated in its reasoning, the lower court reversed the judgment of the first instance that found the Defendant guilty on the facts charged of this case, and sentenced the Defendant not guilty.

Examining the record, the above determination by the court below is justifiable.

There is no illegality of exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or of misapprehending the legal principles on the trial-oriented principle and direct examination principle.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
