Defendant

A shall be punished by a fine of 5 million won, and B shall be punished by a fine of 3 million won.

The above fine shall not be paid by the Defendants.

Punishment of the crime

C, D, and E have obtained nationality by falsely reporting the birth of a baby born in the Republic of Korea by a Korean national's child, and after obtaining a passport, they are broscersed to arrange the birth of a baby departing from Vietnam by obtaining a passport. Defendant B, and Defendant A are Korean nationals who have falsely reported the birth of a baby and sent the baby to a foreign country.

1. On March 201, 201, Defendant B accepted Defendant C’s proposal that “I will have a child born between Vietnam and Vietnam’s illegal stay F as a national’s child and make a passport so that I can leave Vietnam by creating a passport.”

C 1.5 million won to Defendant B and the above son as Defendant B’s child, and conspired to obtain a passport after reporting the birth of Defendant B.

On March 18, 2011, the fabrication C of private documents: (a) by requesting a single-name “G” to forge a birth certificate necessary for the report of birth; (b) forged one copy of a birth certificate indicating “B”, “F”, “H hospital” in the name column of the place of birth, “I” in the name column of the place of birth, “I” in the sex column of the baby, “n” in the body column, “3.26km”, “n” in the body column, “H hospital, number, K, and doctor’s name L”, and then forged one copy of a birth certificate affixed to L’s name.

As a result, Defendant B forged one copy of the birth certificate in the name of L, a private document related to the fact-finding for the purpose of uttering in collusion with C.

B. Around November 30, 2010, Defendant B, along with C, filed a report of birth on “M” at the Dong Office of the Government 2-dong in the House of Government Dogjin-ro, the foregoing investigation document was submitted to the public official in charge of being aware of the forgery, and exercised the forged birth certificate as if it were duly constituted.

(c) Defendant B shall contain any false entry into public electronic records, etc. and any false entry into public electronic records, etc.
