1. Facts of recognition;

A. Each land indicated in the separate sheet Nos. 1 and 2 (hereinafter “instant land”) is the land originally divided into 4,364 square meters of Gangseo-gun C forest land (hereinafter “instant land before the instant partition”); and the land indication is only the lot number.

B. The Plaintiff’s cadastral record of the area where the land was located before the instant partition was entirely destroyed during the period of 625 war, and thus, it was impossible to confirm the owner’s identity, and the cadastral record was restored on March 15, 1973.

다. 피고 A은 1988. 2. 12.경 관할 소관청인 강원 화천군에 이 사건 분할 전 토지에 관하여 소유자복구등록을 신청하여 1989. 8. 3. 망부(亡父) D 명의로 구입한 타 토지 매매계약서의 별지 토지 목록 하단에 이 사건 분할 전 토지의 지적 및 지번을 추가 삽입 기재하는 방법으로 이 사건 분할 전 토지에 관하여 D가 구입한 것처럼 매매계약서를 위조하여 수복지역내미복구토지의복구등록과보존등기등에관한특별조치법(이하 ‘특별조치법’이라 한다)에 따라 이 사건 분할 전 토지의 임야대장에 D를 소유자로 소유자복구등록을 한 다음 춘천지방법원 화천등기소 1995. 1. 11. 접수 제76호로 D 명의의 소유권보존등기를 마쳤고, 이로 인하여 1998. 1. 21. 공정증서원본불실기재죄 등으로 징역 10월에 집행유예 2년의 유죄판결을 선고받았다.

After that, on August 3, 1995, Defendant A completed the registration of ownership transfer on the land prior to the subdivision of this case based on donation.

Meanwhile, on November 19, 2013, E forest land 53 square meters, F forest land 1,155 square meters, G forest 243 square meters on June 18, 2015, H forest 215 square meters, 215 square meters, and 353 square meters of I forest 353 square meters in each of the instant land before the instant partition, and the remaining forest 1,865 square meters became C land.

E. However, Defendant A is the land indicated on October 10, 2013 in the separate sheet No. 1,155 square meters of F forest land, and the remainder of the land before the instant partition.
