A은 사기도박 총책으로서 ‘목 카드’ 및 특수 카메라 등을 준비하고 L에게 도박을 할 사람을 물색하도록 하고, 그 지시에 따라 L은 2013. 2. 하순경 평소 알고 지내던 피해자 M에게 카드 게임을 하러 놀러오라고 하여 위 피해자와 그 지인인 피해자 N를 위 사무실로 불러 모으고, 2013. 2. 26.경 위 사무실에서 피고인 B, 피고인 D, 피고인 C은 소위 ‘선수’로서 사기도박을 하는 사실을 숨긴 채 피해자들과 카드 52매를 이용하여 최초 4장을 받은 뒤 순서에 따라 3회에 걸쳐 카드를 교환하면서 돈을 걸고, 최종적으로 남은 카드 중 서로 다른 무늬와 낮은 숫자의 카드를 가진 사람이 승리하여 도금을 가져가는 방식으로 속칭 ‘바둑이’ 도박을 하면서 피고인 A의 지시를 받은 성명불상자로부터 바닥에 놓인 카드나 피해자들이 들고 있는 카드가 어떤 것인지를 귀에 착용한 이어폰으로 들어 알고 있으면서도 마치 정상적인 도박을 하는 것처럼 가장하여 피해자들로 하여금 위 ‘바둑이’ 도박을 계속하게 하여 이에 속은 피해자 M으로부터 150만원을, 피해자 N로부터 900만원을 땄다.
