A defendant shall be punished by imprisonment for four years.

The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.

Punishment of the crime

The Defendant served as a member of the Gangdong-gu Seoul Metropolitan Government B hotel from November 2018, and from March 11, 2019, from around 22:00 to around March 22:00, the Defendant was in office at night at the above hotel town, and the working hours are affixed the following seals.

3. From 12.10 to 10:00

At around 01:10 on March 12, 2019, the Defendant: (a) was working at the hotel in the above hotel in a night room; (b) was drunkd with the victim C (n, female, and family) and the victim’s male-child room in the above hotel D; (c) on the same day, at around 02:27, the victim’s male-child room left the room first after leaving the victim only; and (d) was willing to have sexual intercourse with the victim left the said hotel D using the above hotel marina.

이에 따라 피고인은 같은 날 04:57경 위 호텔 마스터키를 이용하여 위 호텔 D호의 문을 열고 조심스럽게 침입하여, 피해자가 술에 취해 옷을 벗고 침대 위에 혼자 누워 깊은 잠에 빠져있는 것을 확인한 후 침대에 올라가 피해자의 입에 키스를 하고 손으로 피해자의 온몸을 만지고 혀로 피해자의 가슴을 핥고 손가락을 피해자의 성기에 집어넣고 나아가 피고인의 성기를 피해자의 성기에 삽입하려고 하였으나, 이와 같은 피고인의 이상한 행위에 놀라 잠이 확 깬 피해자가 “누구세요 ”라고 외치고 손으로 피고인의 목을 밀고 “아아악~~!!”이라고 비명을 지르는 등 저항을 하자, 결국 같은 날 05:21경 급히 위 객실을 빠져나와 엘리베이터 대신 비상계단을 이용해 10층에서 지하 1층까지 내려가 바로 옷을 갈아입고 위 호텔을 빠져나갔다.

Accordingly, the Defendant invaded into the room possessed by the victim, and attempted to have sexual intercourse with the victim by taking advantage of the victim's mental or physical condition or non-operance. However, the Defendant did not bring the victim's resistance and failed to do so.
