A defendant shall be punished by imprisonment for not less than eight months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Where any person who violates the Livestock Products Sanitary Control Act slaughters livestock, such as black salt, he/she shall do so at a place of work permitted by the competent administrative agency for slaughter treatment, etc., and any person who intends to operate slaughter business, such as slaughter of livestock shall obtain permission from the competent administrative agency, and no person shall sell livestock products slaughtered without such permission nor treat, process, pack, use, import, store, transport or display them for sale;

Nevertheless, the Defendant, while operating slaughter business without obtaining a slaughter business license in Dongdaemun-gu Seoul Metropolitan Government with the name of “D”, was equipped with electric shockers, sprinkers, etc. to slaughter in the said place of business. On April 1, 2008, the Defendant: (a) slaughtered black salt to 1.90,000 won; (b) slaughtered black salt to “H” selling black salt extractions, etc. in Dongdaemun-gu Seoul Metropolitan Government, by using the trade name of “F” from around 265,256,60,000 to April 1, 2013; and (c) sold black salt with 1.9,000 won, such as killing black salt 1,414,00 won.

2. No person who violates the Food Sanitation Act shall use livestock products that have not been inspected in relation to slaughter business for the production or processing of food;

Nevertheless, around February 22, 2012, the Defendant, at the Defendant’s place of business as indicated in the above paragraph (1) above, manufactured or processed food products that were not inspected, such as by inserting black salt slaughtered in a hot-dried salt farm equipped with the above place of business in accordance with the order of customers.
