Defendant shall be punished by a fine of KRW 2,000,000.
If the defendant does not pay the above fine, 50,000 won.
Reasons
Punishment of the crime
1. At around 11:00 on February 21, 201, the Defendant forged private document: (a) made use of fences on the paper of a new service contract that was kept there at the D retail store located in Gangseo-gu Seoul Metropolitan Government; (b) made use of fences on the name column; (c) “E”; (d) “F” in the phone number column for contact; (c) “G”; and (d) in the column of address for receipt of the written request, “Seoul Gangseo-gu H”; and (d) in the column of the bank applying for automatic transfer, “I”, “J” in the Account Number column; and (e) signed “E” on the name side of the applicant customer column.
Accordingly, for the purpose of uttering, the Defendant forged a new service contract in the name of E, a private document on rights and obligations.
2. The Defendant, at the time and at the place specified in paragraph 1, exercised the forged new service contract to K as if it had been duly formed.
3. The defrauded presented the date and time stated in Paragraph 1, one copy of the service new contract and the copy of the E’s resident registration certificate that the Defendant possessed by the Defendant at the same time and place, stating that “Ahn't have any traffic accident but the cell phone was lost or created at the hospital in question,” and as if he had a legitimate right to subscribe to new mobile phone service in his name, he made a false statement to the victim K, and then he received one cellular phone license from the victim at the time of Samsung galthalth of the market price and acquired it.
4. The Defendant in violation of the Resident Registration Act committed as if he had a legitimate authority to subscribe to mobile phone services in his name in order to prepare a new service contract at the time and place specified in paragraph (1), and as if he had a legitimate authority to subscribe to mobile phone services in his name, and the completion of the contract is one’s own mobile phone at L’s account.
