Defendant shall be punished by a fine of two million won.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
1. On September 13, 2018, the Defendant: (a) obtained a credit card No. 365 of the CB from the CB in Goyang-dong, Yongsan-gu, Goyang-si; (b) on September 13, 2018, a credit card No. 365 of the CB, which was owned by the CB; (c) but was returned to the victim or embezzled without submitting it to the police agency.
2. Violation of the Specialized Credit Financial Business Act and fraud;
A. On September 13, 2018, the Defendant: (a) around 17:48 on September 13, 2018, presented the completion of the pertinent “D-owned E- Card,” as stated in the said “1, at G pharmacy located in Seoyang-gu, Seoyang-gu, Seoyang-gu; and (b) paid the purchase price of drugs in KRW 42,00,41,000, total amount of KRW 83,000 on two occasions, by presenting it to the person who was unaware of the pharmaceutical’s name.
As above, the Defendant deceivings the victim, who is a pharmacist’s name, and acquired the medicine of KRW 83,00 from the victim, and used the embezzled credit card.
B. On September 13, 2018, around 17:55, the Defendant settled the purchase price of medicine amounting to 56,000 won, citing that D’s acquisition, such as D’s “1,” at the I pharmacy located in Young-gu, Young-gu, Seoyang-gu, Seoyang-gu, J, had the right to use as his/her card, as if he/she had the right to use it as his/her card.
As above, the Defendant deceivings the victim, who is the victim, and acquired the medicine equivalent to 56,00 won from the victim, and used the embezzled credit card.
C. At around 18:00 on September 13, 2018, the Defendant settled the purchase price of medicine amounting to 60,000 won, citing that D-owned E- Card, which was acquired at the K pharmacy located in Seoyang-gu, Seoyang-gu, Seoyang-gu, Seoyang-gu, J, had the right to use as his/her card, as if he/she had the right to use as his/her card.
As above, the Defendant deceivings the victim, who is the victim, and acquired the medicine equivalent to 60,000 won from the victim, and used the embezzled credit card.
