Defendant
E is a person who was sentenced to the suspension of the execution of imprisonment for six months at the Incheon District Court on October 8, 2013 for fraud and was finally decided on the 16th of the same month.
L is a person operating a corporation that operates and manages the N in Bupyeong-gu Incheon Metropolitan City N, and Defendant K is a nearby resident, Defendant J, F, G, H, I, C, D, E, and B.
L purchased approximately 50% of the shares in the above building around December 2012, and merchants, including victims Q, in the front of the Pmate on the first floor of the above building, were willing to prevent victims from operating the street store according to the steel market on the ground that the operation of the street store and interfere with the exercise of the above building ownership. On January 21, 2013, Defendant K and the branch Defendant J directed Defendant C, A, D, E, and B, the branch Defendant K, to gather the number of persons to install the street board as above, and Defendant C, D, E, H, and I, the branch Defendant J requested Defendant F, H, H, H, and I to install the street board together.
1. On January 21, 2013, at around 21:00, the Defendants, in collusion with L, obstructed the operation of the street stores of victims, such as the list of victims in the same manner as the list of victims, by preventing the establishment of iron plate (3m x 1.5m x 1m) in front of the fish store operated by the victim Q from entering, leaving, and selling the salted fish in collusion with L, thereby obstructing the operation of the street store of the victims, such as the list of victims, in the same manner.
2. The Defendants, in collusion with L on January 21, 2013, destroyed the victims’ property in the aggregate amounting to KRW 6,905,50,00 in total, as shown in the attached list of damages in the same manner, in collusion with L, at around 21:00, the Defendants: (a) thrown fish sled on the way in front of the aforementioned Ptept, at the speed of the instant Ptept; and (b) thrown up a board, air conditioning, etc., at the speed of 942,50 won in total; and (c) jointly destroyed and damaged the victims’ property in the same manner as in the attached list of damages.
