A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person operating company E which operates and manages the D building in Bupyeong-gu Incheon Metropolitan City, and F is a nearby resident, the chief of the management office, G, H, I, J, K, K, L, M, N,O, P, and P.

On December 2, 2012, the Defendant purchased approximately 50% of the shares in the above building, and, on the grounds that the merchants, including the victim R, operated a street store in front of Qho on the first floor of the said building and interfere with the exercise of ownership in the said building, the Defendant was willing to prevent the victims from doing business by blocking the entrance of the street store according to the iron market.

1. On January 21, 2013, the Defendant: (a) instructed L, M, N,O, P, and G to gather the number of persons who install the iron plate from the above D building, and (b) requested L, M, N,O, P, and G to install the paint together with the terrain H, I, J, and K.

At around 21:00 the same day, the Defendant, together with F, G, H, I, J, K, L, M, N,O, and P, set up iron plate (3m x 1m x 1m) in front of the fish store operated by the victim R on the top of the fish store operated by the victim R of the above D 1st floor, and obstructed the operation of the work on the street of the victims such as F, G, H, I, K, K, L, M, N,O, P in collusion with the same time and manner, and interfere with the operation of the work on the street of the victims such as the attached list 1 (victim list).

2. On January 21, 2013, the Defendant: (a) committed a violation of the Punishment of Violences, etc. Act (joint destruction and damage) with F, G, H, I, J, K, L, L, M, N,O, P, and the Defendant: (b) committed a damage to the victims’ property equivalent to KRW 6,905,50 in total, in the same time and in the same manner, by throwing down the salted fish on the paths owned by the victim R in front of the above Qu, or walking the bags, string, cooling, cooling, etc.; and (c) committed an act of damaging the salted fish amounting to KRW 942,50,00 in total, as in attached Table 2 (damage List).
