1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On October 23, 2007, E entered into an insurance contract with the Plaintiff as the insured E, beneficiary heir at the time of death, and the insurance period life, and the standard insurance contract for non-dividendd life insurance (hereinafter “instant insurance”). In the event that the insured E dies due to a direct cause during the insurance period (the age of 80), the insurance contract was also entered into with a special agreement for accident death (hereinafter “instant special agreement for accident death”).
B. (1) The insurer of the terms and conditions of the instant special agreement for death of a disaster under Article 10 (Types and Grounds for Payment of Insurance Money) of the terms and conditions of the special agreement for death of a disaster under Article 10 (Types and Grounds for Payment of Insurance Money) may terminate this special agreement simultaneously with the failure of the insurer to pay the insurance money if the insured has died directly due to a disaster during the insurance period, or if the insured has become disabled by not less than 80% of the total disability payment rate due to the same disaster under the disability classification table.
Subparagraph 1: A case where the insured has intentionally impaired himself/herself, but this shall not apply to cases where the insured has impaired himself/herself in a state of mental illness and where he/she has committed suicide after two years from the date of commencement of guarantee of a special agreement (in cases of an inevitable contract, the date of reinstatement subscription), or has caused a disability
3. Under the Disaster Classification Schedule 2 attached to the Terms and Conditions of the Contract of this case, the term "disaster" refers to a contingency accident corresponding to S00 to Y84 under the Korean Standard Disease Disease Control Classification, and 2. A contagious disease referred to in Article 2 (1) 1 of the Prevention of Contagious Diseases Act.
