A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. From January 2012 to February 2014, the Defendant: (a) served as an agent of the victim Dogsan Branch D in South Won-si; and (b) was in charge of purchasing feed and other feed.

around June 26, 2012, the Defendant embezzled KRW 13,686,00,00, total sales proceeds of 10 times in total, as described in the separate sheet (1), from around that time to January 8, 2014 by means of the following methods, without entering the amount of KRW 2,640,000, which is equivalent to the amount of KRW 2,640,000, from Jinju Packaging Co., Ltd., even though he was supplied on credit from Jinju A branch in the account book, and sold it to his name in the account book, and then arbitrarily consumed the sales proceeds as living expenses, etc. while carrying out business for the victim.

B. Around January 8, 2013, the Defendant: (a) sold agricultural feed equivalent to KRW 468,520 from the Namwon Livestock Cooperatives without entering it in the account book; and (b) embezzled the sales proceeds at will from around the time to May 27, 2013, by individually consuming KRW 2,783,410, total sales proceeds for six times in total, as described in the separate sheet of crime (2) in the following manner, from around that time to May 27, 2013.

C. Around June 19, 2013, the Defendant: (a) entered in the account book as if he transacted with E, even though he/she sold general materials equivalent to KRW 1,334,082 to his/her name impaired; and (b) voluntarily consumed the sales proceeds from the cost of living, etc. while being kept in the business for the victim; and (c) from around that time to February 25, 2014, the sales proceeds over 28 times in total, as described in the attached list of crimes (3).
