1. The plaintiff's claim is dismissed.

2. The costs of the lawsuit, including the part resulting from the supplementary participation, are all assessed against the Plaintiff.

1. Details of the decision;

A. On March 1, 2014, the Plaintiff was newly appointed as a teacher of Chigh School established and operated by the Intervenor joining the Defendant (hereinafter “ Intervenor”) and served as a school teacher.

B. On September 27, 2016, the Plaintiff was subject to disciplinary action against the Intervenor pursuant to Article 61(1)1 through 3 of the Private School Act and Article 2 of the former Rules on Disciplinary Action, etc. on Public Educational Officials (wholly amended by Ordinance of the Ministry of Education No. 128, Mar. 24, 2017; hereinafter the same) due to the following disciplinary grounds (hereinafter “instant disciplinary action”).

In 2016, the Plaintiff attempted to make a sexual manipulation by unfairly correcting the OMR answer sheet of an unspecified student among the 1st 6-9-year 1st 6-9-year 2nd 1st 2016 - 7th 12th 7th 201 and 22th 7th 2016 - the re-examination was conducted on the completion of the relevant subject (the 1st 2nd 1st 1st 2nd 22th , and a lot of problems related to the re-examination were caused by the re-examination. The Plaintiff attempted to commit an unjust act that prevents student performance in the work related to the evaluation of teachers to be fair, thereby seriously hindering the Plaintiff’s duty of good faith as well as the performance of public duties, and seriously impairing the trust in the education and evaluation of schools.

On January 18, 2017, the Plaintiff appealed against the above disciplinary action and filed a petition for the review of the appeal against the Defendant, and the Defendant rendered a decision to dismiss the removal from office on January 18, 2017, taking into account the following: (a) the Plaintiff was found to have been guilty of the disciplinary action; (b) but at that time, the Plaintiff instructed to the serious level of depression due to the death of singking and referring teachers

hereinafter referred to as "the case."
