A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On April 26, 2012, the Defendant was sentenced to one year and two months of imprisonment for fraud, etc. in the Western District Court Branch Branch of the Daegu District Court on February 11, 2013, and completed the execution of the sentence in the port prison.

On February 2013, the Defendant posted a letter “I am 45,000 won of rice directly sold to 45,000 won,” on the PC bulletin board of the following Kapet-dong, Nam-gu, Daegu-gu, Daegu-si, Daejeon.”

The Defendant read the above writing to the victim’s name unclaimed (here-be: D) who read and contacted the said writing, and made a false statement to the victim that “I would deliver the money first to the victim.”

However, there was no intention or ability to deliver rice even if the defendant did not collect rice and did not have rice to sell, and received money from the victim.

On February 20, 2013, the Defendant, by deceiving the victim as above, received 45,000 won from the victim, under the name of the Defendant, as the sales proceeds of rice from the Mez securities account in the name of the Defendant.

In addition, from around that time to June 30, 2013, the Defendant deceiving victims by the same method 38 times in Seoul and Daegu, such as the list of crimes in attached Table 26,05,50 won in total as the sales proceeds of agricultural products, etc., and acquired them by deception.

The indictment is written in 550,000 won, but it is deemed that the amount obtained by deception 9 is 350,000 won, so it is recognized as 350,000 won (per 341 pages of investigation records) and the sum is recognized as 26,255,50 won, unlike 26,255,50 won in the indictment.

The written indictment contains that 2,100,000 won was acquired on May 19, 2013 as to 28, 2013, but the Defendant received 100,000 won on May 19, 2013, and 2,000,000 won on May 20, 2013, and such recognition is recognized as above.
