Defendants shall be punished by imprisonment for six months.
However, each of the above penalties shall be executed for two years from the date this judgment becomes final and conclusive.
Reasons
Criminal facts
1. The Defendants posted a notice to sell goods on the Internet NAVD page, and then conspired to acquire money by deceiving money as if they deliver the goods immediately if they deposit money to the purchaser who asks for sale by letters or telephone.
On November 18, 2012, the Defendants posted a notice on the Internet D PC bulletin board around the Gwanak-gu Seoul Special Metropolitan City EPC, stating that they would immediately deliver deton character smartphones upon deposit of money to the victim F who reported the above notice and requested purchase.
However, even if the Defendants received the price of goods from the victim, they did not have the intention or ability to sell smartphones.
As above, the Defendants, by deceiving the victim, received KRW 70,00 from the victim to the single bank account (H) in the name of G, and received KRW 70,000 from the victim, and by deceiving the victims over a total of 20 times as shown in the attached list of crimes in the attached list of crimes, were remitted total of KRW 10,021,50.
2. Defendant A
A. On October 15, 2012, the Defendant posted a false statement to the PC page in Songpa-gu Seoul, Songpa-gu, Seoul, stating that he/she will immediately deliver gallonis if he/she deposits money to the victim I who reported the above notice and requested purchase.
However, even if the defendant has received the price of goods from the victim, he did not have the intention or ability to sell gallonies.
The Defendant, by deceiving the victim as above, received KRW 100,00 from the victim to the bank account in the name of B.
