Punishment of the crime
[Power of crime] The Defendant was sentenced to a suspended sentence of two years on August 27, 2016 by imprisonment with prison labor for special larceny in the Goyang Branch of the Jung-gu District Court on August 19, 2016 and the judgment became final and conclusive on August 27, 2016.
[Criminal facts] 2016 Highest 5280
1. On December 19, 2015, the Defendant, at the Defendant’s domicile in Seo-gu, Incheon, posted a false statement as if he could sell a small vehicle without intent or ability to sell the goods even if having received money, and as if he could sell a small vehicle, at the Defendant’s address in Seo-gu, Incheon, by receiving KRW 100,000 on the same day from the injured party as the foreign exchange bank account (D), KRW 200,000 on the same day, around the 24th of the same month, and KRW 70,000,000 on the 31st of the same month from the injured party.
2. On January 4, 2016, the Defendant, at the Defendant’s domicile located in Seo-gu Incheon, Seo-gu, Incheon, by deceiving the victim as if he could sell any eball vehicle at the Internet trading site in the same manner as that of the preceding paragraph, and then by deceiving the victim to transfer the 7,000,000 won from the victim to the above account on the same day.
3. On January 11, 2016, the Defendant, at the Defendant’s address located in Seo-gu Incheon, Seo-gu, Incheon, by deceiving the victim as if he could sell Sota vehicle at the Internet trading site in the same manner as that of the above paragraph 1, and then by deceiving the victim to transfer KRW 2,50,000 from the victim to the above account on the same day.
4. On May 7, 2016, the Defendant, at the Defendant’s domicile located in Seo-gu Incheon, Seo-gu, Incheon, by deceiving the victim as if he could sell king A, in the same manner as the above paragraph 1, at the Internet site, at the Defendant’s domicile in Seo-gu, Incheon, by deceiving the victim, and then receiving KRW 170,000 from the victim to the above account on or after the same month.
