Defendant shall be punished by a fine of KRW 1,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

A person who intends to use a river for the purpose of the improvement and development of the living industry and the agricultural environment shall obtain permission from the Minister of Environment, as prescribed by Presidential Decree.

The Defendant is a person who, from April 7, 2020 to May 8, 2020, works as a field warden at the construction site of neighborhood living facilities located in Sinung-si B from around May 7, 2020 and has overall control over the field affairs, such as human management and work instruction.

On April 14, 2020, the Defendant made a statement to the effect that C, an engineer, who was requested to draw water for the removal of fugitive dust at the construction site at the above site, “dumping water” was “dumping water,” and that C, upon collecting approximately five-t river water from a wood-conditioning 102, the luminous-dong 102, displayed a certificate of report on the use of the river taken from the Defendant’s cell phone, and the Defendant said C, “in order to draw a river, the Defendant made a report to the Han River Flood Control Office and sent a document by facsimile to the effect that “A person was required to obtain a certificate of report.” However, C did not take measures, such as making a report to C, stating that “A person was aware of” and then leaving the water already drawn or leaving the river at the Han River Flood Control Office. From that time, C did not take measures from that year thereafter.

4. From the above 23th day to the above 10th day, the number of rivers of about 5t per 10 times was drawn and transported to the above construction site.

Accordingly, the Defendant, in collusion with C, collected the river water without obtaining permission from the Director of the Han River Flood Control Station who was delegated the permission to use the river water from the Minister of Environment.
