1. The plaintiffs' claims against the defendants are all dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. The following facts do not conflict between the parties, or may be acknowledged in full view of the following facts: Gap evidence 1-2, Gap evidence 4, Eul evidence 8, Eul evidence 9-1, 2, Eul evidence 14, Eul evidence 1-1, 4-3, Eul evidence 9, 10, 12, 13, 15, 16, 81, 97, 120 through 122, 143, 169, 176, 192 through 197, and the whole purport of the pleadings by witness H's testimony.
The former I department store commercial building (hereinafter “former commercial building of this case”) located in Jung-gu Seoul, Jung-gu, E, F, and G, was constructed as one business establishment in the 288 business establishment, 1, 2, 2, 5, 2, 2, 2, 5, 3, and 82 square meters in the 288 square meters and 4, respectively. A part of the site of the previous commercial building of this case was removed from the part of the previous commercial building of this case due to the building of 231.1 square meters in the 231.1 square meters in the Seoul Special Metropolitan City, Jung-gu, Jung-gu, Seoul and the 591 square meters in the 4th 1,2591 square meters in the 591 square meters in the 592,5294, 3544, 454, 1965 square meters in the 197.
The registration of multiple sectional ownership has been completed in the new commercial building of this case, and the 42 registers concerning sectional ownership have been compiled at present.
B. Around December 27, 1966, the Plaintiff’s father L, the father of the Plaintiff (hereinafter “the Plaintiff”), acquired the ownership of subparagraph 17 of the former Commercial Building, and on June 8, 1989, the registry of the above building was bound as a building listed in the attached list (hereinafter “registration section of the Plaintiffs”). The Plaintiffs’ registered portion or the buildings owned by other sectional owners are not divided into bearing walls, etc.
The plaintiffs were donated from the deceased on March 21, 1995 their respective shares of 25.52/78.02 shares among the plaintiffs' registrations, and completed the registration of share ownership transfer in the plaintiffs' names on March 27, 1995, and the deceased died.
