A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

피고인은 2016. 5. 7.경 대전서부경찰서 B지구대에서 택시기사와 시비가 되어 택시기사가 위 지구대로 피고인을 데려온 후, 피고인의 신병을 인수하러 온 딸과 귀가하던 중 지구대 앞 노상에서 딸과 시비를 하여 딸이 신병 인수를 포기하고 가 버리자 차로에 뛰어들려 하고, 경찰관이 피고인을 데리고 다시 위 지구대로 들어와 보호조치를 하던 중 위 지구대 바닥에 드러누운 채 “경찰관새끼들 다 죽여 버린다, 너희들의 목을 따겠다 개새끼들아”라는 등으로 소리를 지르며 데스크를 발로 수회 차고, 위 지구대 순경 C이 이를 제지하자 “너 꺼져 이새꺄”라는 등의 욕설을 하면서 발로 위 C의 다리를 1회 차고, 경위 D에게 “내가 너희들 때문에 허리를 다쳤는데 너 이젠 인생 끝났다, 옷을 벗기겠다.”라는 등으로 욕설을 하며 접이식 의자를 집어 던지려 하고, 이를 제지하는 C의 얼굴을 손으로 1회 때리려 하였다.

Accordingly, the Defendant interfered with the legitimate performance of official duties by police officers on the duty to protect the police officers.
