Punishment of the crime

[criminal records] On July 12, 2013, the Defendant was sentenced to ten months of imprisonment for fraud at the Seoul Northern District Court, and on January 29, 2015, the Seoul Central District Court sentenced two years of imprisonment for fraud at the Seoul Central District Court, and completed the execution of the sentence at the Port Prison on August 22, 2016.

[Criminal facts]

1. On November 5, 2016, the Defendant found one copy of the Agricultural Cooperative C Card owned by the victim C from a defung Pung Pung-gu near the new wall 280, as the new wall was corrected in Sungnam-si, Sungnam-si.

Defendant 1 did not take necessary procedures such as returning the above acquired property to the victim, but did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

2. Violation of laws concerning fraud and finance business specializing in lost debit cards;

A. On November 5, 2016, at around 02:56, the Defendant purchased one tobacco equivalent to KRW 4,500 from the E convenience store operated by the victim’s name in Seongbuk-gu, Seongbuk-gu, Sung-gu, Sung-gu, Seoul, to pay the purchase price of KRW 500,00, as described in the above paragraph (1), by presenting the Agricultural Cooperative C’s C’s physical card, as one’s own act, to the employee and signing it on the card machine, and then, the Defendant was using the e-mail card, by acquiring the said goods from a staff member, by thefting them, and by losing them.

B. On November 5, 2016, around 11:12, the Defendant purchased one of the beverages equivalent to KRW 4,500 from the E convenience points indicated in paragraph (a) of Article 2 at around 11:5,00, and offered C’s e-mail card, as described in the foregoing paragraph (1), to an employee, and then settled the same by signing it on the card machine, and then received the said goods from an employee.

Accordingly, the defendant, by deceiving the victim, received property and used lost debit cards.
