Punishment of the crime

Defendant

A is a business owner who operates a game room using a private gambling site in Gangdong-gu Seoul Metropolitan Government C Building D, and the defendant B is an employee of the above game room.

A person who is not the Korea Lottery Commission, a person who has been entrusted with the business of issuing lottery tickets or a person who has not been re-entrusted shall not issue lottery tickets, and a person who intends to engage in speculative business which makes profits or losses by collecting goods or property from many persons and determining profits or property by an incidental method shall obtain permission from the commissioner of a district police agency, and no person shall open a gambling place for profit.

Nevertheless, from March 27, 2019 to May 8, 2019, Defendant A issued online lottery tickets in which the “F” program, which is a private online gambling site, is included in a computer where the “F” program is operated in the said game site, so that customers who enter the said game site can take money from the customers who enter the said game site, using a lottery ticket ticket, etc. The above online lottery ticket is input into a computer, and the above customers are engaged in speculative businesses by exchanging winning money according to the rate of distribution according to the result of the game, and the above customers are entitled to receive 3.2% of the amount of winning money paid by the users of the gambling program from March 27, 2019 to May 8, 2019, Defendant B opened a gambling place by using the above-mentioned computer in the above game site, and Defendant B issued the above lottery ticket to the employees from May 26, 2019 to May 19.

Accordingly, the Defendants shall issue lottery tickets even though they are not the Korea Lottery Commission, etc., and without obtaining permission from the Commissioner of the Local Police Agency.
