A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a proprietor who operates a game room using a private gambling site in the Gangdong-gu Seoul Metropolitan Government Btel C heading room.

A person who is not the Korea Lottery Commission, a person who has been entrusted with the business of issuing lottery tickets or a person who has not been re-entrusted shall not issue lottery tickets, and a person who intends to conduct speculative businesses which make profits or losses in property by collecting property and property benefits from many persons and by determining them in an incidental manner shall obtain permission from the Commissioner of the Local Police Agency, and no person shall open a gambling place

Nevertheless, from March 30, 2019 to May 21, 2019, the Defendant issued online lottery tickets in which the Defendant relays the “D”, which is a speculative act implemented in the said Office E, or directly betting money, to enable customers who enter the said game room by using a computer in which the program of “D” is entered, and a lottery ticket so that they can get money from the customers who enter the said game room. The Defendant entered the contents of the betting by using the said online lottery, and then exchanged the winning money according to the result of the game, thereby obtaining 3.2% of the amount of the betting amount by which the users of the D gambling program receive 3.2% of the betting amount from the commission, and let the said customers do gambling by using the computer in which the said D program is input in the said game room.

As a result, the defendant issued lottery tickets even though it is not the Korea Lottery Commission, conducted speculative business without obtaining permission from the commissioner of a district police agency, and opened a gambling place for profit.
