Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is a person who is engaged in driving a fourth car.

The driver of any motor vehicle who intends to overtake another motor vehicle shall pay due attention to the traffic in the opposite direction and the traffic in front of the motor vehicle traveling ahead, and overtake the other motor vehicle traveling ahead at a safe speed and in a safe manner, such as using the directionors depending on the speed and route of the motor vehicle traveling ahead and other road conditions, and he/she shall not temporarily drive the motor vehicle traveling ahead of it, such as suddenly stopping the motor vehicle driving or reducing its speed, unless it is necessary to prevent danger and other inevitable circumstances.

피고인은 그때 전방에서 진행 중이 던 피해자 C(31 세) 의 스포 티지 승용차가 피고인과 같은 차로로 변경하여 진로 변경에 방해를 받자, 이에 화가 나 상향 등을 깜박이며 더욱 가속을 하여 피해자를 뒤쫓고, 피해자가 3 차로에서 4 차로로 차로를 변경하자 계속하여 피해자를 뒤쫓아 같은 차로로 변경하고, 다시 피해자가 3 차로로 차로를 변경하자 더욱 가속하여 갑자기 피해자의 승용차 앞으로 끼어들고, 곧이어 전방에 아무런 장애물이 없었음에도 불구하고 브레이크를 밟아 난폭 운전을 하였다.
