1.The judgment of the first instance, including a claim modified at the trial, shall be modified as follows:
The plaintiffs.
Reasons
1. The following facts are found either as a matter of dispute between the parties or as a whole as stated in the evidence Nos. 1, 2, 3, 8, 9, 10, 14, 22, 25, 26, 27, 35 (including each number), and the whole purport of the arguments.
A. In around 190, the Defendant began to live together with L(Defendant’s wife), Plaintiffs (six persons), M, N,O, P, Q, Q, Q, M, T (former names: U), and V (former names: W) as a leader in Yangsan City.
N,O, and P have left their lives thereafter.
B. At around April 1990, the plaintiffs and the defendant et al. started to manufacture Ma as the representative in the above X-X with the trade name of "K". Around 1991, the representative was replaced to N, but the representative was changed to J Co., Ltd., a corporation around 193.
C. The J Co., Ltd. was established around October 193, and the N paid the capital of the J Co., Ltd. by receiving a loan of KRW 50 million on May 14, 1993, and the N Co., Ltd paid the said loan of KRW 40 million on May 13, 1994, and the J Co., Ltd repaid the said loan of KRW 40 million on March 17, 1995.
J Co., Ltd. increased its capital by increasing its total amount of KRW 850 million on January 18, 1996, KRW 150 million on October 199, KRW 199, KRW 169,000 on November 16, 199, KRW 169,000 on November 16, 199, KRW 130,000 on December 2, 199, KRW 100 million on January 30, 2008.
At the time of the establishment of the J Co., Ltd., the Defendant entered 51% (5,100 note/100 note), F, N (the initial representative director of the J Co., Ltd.), M (the representative director as at the time of the J Co., Ltd.), H, Q, P,O, and R in each 7% (=700 note/10), and transfer to the Defendant around 75% (65% (=17,000 note/180), M in each of the following table, around 7% transfer to the Defendant around 70% (37,800 note/18000), around 93, around 70% (12,600 note/180), and around 75% transfer to the Defendant, around 70% M. 77% M.
