A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On May 3, 2010, the Defendant forged a private document with intent to open a mobile phone, etc. in the name of C using a driver’s license of a motor vehicle in the name of C, which was received from C to lend a motor vehicle.

On May 31, 2010, the Defendant entered “C”, “F”, “G” and “C” in the name column, “B”, and “G” in the applicant column, using a type of a new service contract form, which was kept in the Gu-Si SK Telecom E, located in the Gu-U.S. Si (U.S.).

As a result, the Defendant, for the purpose of uttering, forged one copy of a new service contract in the name of C, which is a private document on rights and obligations, and forged eight copies of a private document on rights and obligations in the name of C for the purpose of uttering over a total of eight occasions from around that time to August 19, 2010, as shown in Appendix I, as shown in Appendix C.

2. On May 31, 2010, the Defendant filed an application for the opening of a cell phone (phone G) with the above SK Telecom E, and exercised eight copies of a forged private document in the name of C in total as shown in Appendix II between around that time and August 19, 2010, including the Defendant’s completion of a forged new service contract as described in paragraph (1) as if the said new service contract was duly formed.

3. On May 31, 2010, the Defendant: (a) presented a forged service contract and the Defendant’s resident registration certificate, as described in paragraph (1), without any intent or ability to pay the mobile phone price; (b) deceivings employees of the Victim SK Telecom by presenting a forged service contract and the Defendant’s resident registration certificate; and (c) doing so as to pay the mobile phone price in installments.

The defendant is a contract to sell a device in the name of the victim and C.
