1. Defendant A shall be punished by imprisonment for three years.

except that the above sentence shall be executed for five years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Although Defendant A was prohibited from carrying, possessing, using, managing, exporting, importing, manufacturing, trading, or arranging the trade of, or receiving, a psychotropic substance JWH-018 and its similar body (hereinafter “synthetic marijuana” or “herb narcotics”), Defendant A sold synthetic marijuana over four occasions as follows and used five times.

around October 2018, at around 20:0 to 21:00, the Defendant’s home located in Kimhae-si C and at around 3rd floor sold at KRW 1.50,00,00 a vinyl, containing synthetic marijuana in volume, and used once, at the same time and at the same place, in such a manner as to smoke by inserting the synthetic marijuana’s quantity at a stuffed place;

(b) around 20:00-21:00, around January 2019, the Defendant’s house sold at the above Defendant’s house one vinyl, containing synthetic marijuana fluor B, at KRW 1.50,00, and used once in the same manner the synthetic marijuana fluor in the same time and at the same place;

(c) around 20:00-21:00 on February 2, 2019, the Defendant’s house sold at the above Defendant’s house one 1.50,000 vinyl, containing synthetic marijuana fluencies to B, and used once in the same manner, using the synthetic marijuana fluencies in the same time and at the same place;

D. On April 3, 2019, around 20:0 to 21:00, at the above Defendant’s house, two vinyls containing synthetic marijuana in B were sold at KRW 300,00,000, and used once by inserting synthetic marijuana in a pipe in a way of smoking in a pipe in a well-known way at the same time and at the same place, and then using approximately 30 minutes after using them once again in the same way.

2. Defendant B

A. No person who purchases, smokes, or possesses synthetic marijuana may possess, possess, use, manage, export, import, manufacture, trade, trade, or arrange the trade of, or receive, a psychotropic drug, JWH-018 and its similar body (i.e., “synthetic marijuana” or “herb narcotics; hereinafter “synthetic marijuana”).
