1. On July 17, 2017, the Plaintiff (Counterclaim Defendant) filed against the Defendant (Counterclaim Plaintiff) for KRW 52,330,624 and KRW 24,681,309 among them.
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Basic facts
A. The Plaintiff and the Defendant’s existing lease agreement 1) The Plaintiff is a company that engages in automobile maintenance business, etc., and the Defendant is a real estate listed in the separate sheet (hereinafter “each of the instant real estate”).
(2) On December 16, 2010, the Plaintiff concluded a lease contract with the Defendant and each of the instant real estate KRW 300,000,000, monthly rent 27,000,000 (excluding value-added tax), the term of the contract from October 1, 2010 to September 30, 2012, and paid KRW 300,000 as the lease deposit to the Defendant under the said lease contract.
Article 2 (Term of Lease) (2) The term of lease of this contract shall be extended to three years at the time when the initial term of lease expires unless the defendant notifies the plaintiff in writing his intention to object to the renewal of the term of lease six months before the expiration of the initial term of lease.
Article 5 (Liability for Taxes and Taxes) (3) The Plaintiff shall bear all the taxes incurred by the Plaintiff from running the automobile maintenance business in the leased object, regardless of the name of the person liable for payment on the notice, or of the addressee.
except that this paragraph shall apply only to the property tax imposed upon the extension of the period.
Article 6 (Adjustment of Lease Deposit and Monthly Rent) (2) The lease deposit during the extended period shall be 400,000,000 won, and the monthly rent shall be 30,000,000 won, respectively.
The plaintiff shall pay to the defendant the full amount of the lease deposit increased (100,000,000) on the commencement date of extension.
2) Pursuant to Article 2(2), the term of the instant existing lease agreement was extended by three years from September 30, 2012 until September 30, 2015. Pursuant to Article 6(2), the term of the said lease agreement was extended by three years from October 1, 2012 to 400,000,000, monthly rent was KRW 30,000 (value-added tax).
