A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. 모욕 피고인은 2015. 2. 7. 18:40경 서울 강남구 C에 있는 ‘D’ 술집 앞 노상에서, 피고인의 일행이 손님 E의 머리에 찌개를 부었다는 112신고를 받고 출동한 서울강남경찰서 F파출소 소속 경사 G이 피고인이 E에게 욕설하는 것을 제지하자 위 E 등 다수의 통행인이 듣고 있는 가운데 큰 소리로 피해자 G에게 “야, 이런 씹할 놈아, 나하고 경찰복 벗고 맞짱 한 번 떠보자, 좆만 한 경찰새끼야”라고 욕설하여 피해자를 모욕하였다.

2. 공무집행방해 피고인은 위 일시, 장소에서 G로부터 ‘사람들 보는 앞에서 경찰관에게 그렇게 욕설하면 모욕죄로 처벌받을 수 있습니다’라는 말을 듣자, “야, 맞짱 뜨자”라고 욕설하면서 G의 얼굴 가까이에 주먹을 수회 휘두르고 양손으로 G의 가슴을 수회 밀쳐 폭행하였다.

As a result, the defendant interfered with the legitimate execution of duties concerning the dispatch of 112 reported police officers.
