A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. A thief was on board C, a fishing vessel, on or around February 2012. 2. Fraud and violation of the Specialized Credit Finance Business Act;
A. On March 24, 2012, the Defendant: (a) around 01:39 on March 24, 2012, the Defendant: (b) sent the H card (credit card number: I) that was stolen from D, and presented it to the victim as the Defendant’s card; and (c) settled the amount of KRW 50,000 and KRW 250,000 on two occasions at the G main place operated by the victim E in Jindo-gun-gun, Jindo-gun; and (d) paid the H card (credit card number: I) that was stolen from D, as described in paragraph (1).
Accordingly, the Defendant, by deceiving the victim, was provided with alcoholic beverages and services equivalent to KRW 750,00, and D used a stolen credit card.
B. On March 24, 2012, the Defendant ordered food at L restaurants operated by the Victim JJ in Jindo-gun, Jindo-gun, Jindo-do, to make a settlement of KRW 29,000,00, which was a credit card holder who stolen from D, as described in paragraph (1), and presented the completion of the H card (credit card number: I) to the victim as if the Defendant was the Defendant’s card, and settled KRW 29,000 at that place.
Accordingly, the defendant is the victim.
