Defendant
A Imprisonment for one year, and each of the defendants B shall be punished by imprisonment for ten months.
However, for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendants were engaged in the Piping, distribution of miscellaneous stores, etc., under the name of "E" in the construction of the building D or B/138 of the building Heung-gu, Young-gu, Young-gu.
1. On March 10, 2016, Defendant A told the victim F of the above B138 store that “I would like to have it purchased a heavy story and have it installed, and then I see the activities of the club at the same time. I see that I would like to have it stoved if I would like to do so. 3 million won.”
However, the Defendant, along with B, was operating the E store as the enemy without any particular property at the time, and as the operating fund was urgently needed, there was no intention or ability to transfer the E store, even if he received money from the injured party.
Nevertheless, the defendant, as above, made a false statement to the victim, and received 3 million won from the victim to the Saemaul Treasury account in the name of B, and acquired it by fraud.
2. Defendants’ conspiracy to commit a crime
A. The Defendants, who forged a private document and carried out the said investigation document, conspired to make use of the document to obtain investment money from the above F for the business of importing Chinese electricity, and to forge the lease agreement document as if the deposit amount for the above B138 store was 30 million won.

A around July 24, 2016, without authority, entered the name and business registration number of “H stock company” in the column of the standard contract form for the lease of commercial buildings in the B B B138, by using a computer without authority, and printed it out to the column of the location of the standard form for the lease of commercial buildings; “30,000,000 won” in the deposit column; “50,000 won” in the rent column; “50,000 won” in the lease term column; “27, 2017.” in the lease term column; “28, 2015.28; “H stock company” in the lessor column; “B” in the lessor column; and “B” in the lessee column; and the head of the standard contract for the lease of commercial buildings in the name of H (H) which is a private document on rights and duties affixed by the Defendant on his name.
