1. The Defendant shall pay to the Plaintiff KRW 60,00,000 and the interest rate of KRW 12% per annum from October 27, 2019 to the date of full payment.
Reasons
1. Basic facts
A. The Plaintiff concluded a comprehensive automobile insurance contract with C Co., Ltd. (hereinafter “C”) and D SP car owned by the Plaintiff (hereinafter “instant car”) with respect to the Plaintiff and the insurance period from December 17, 2015 to December 17, 2016.
B. Around 20:30 on June 13, 2016, the Plaintiff driven the instant car and proceeded in front of the F Company, Inc., a member-gu Seoul Metropolitan Government, along with one-lane of the two-lane roads from the 6rd intersections to the G Company, from the 6rd intersections in Ansan-si.
C. At the time, the Plaintiff’s running direction obstructed two-lanes due to the construction work, and the HJ-type passenger cars (hereinafter “HH”) and Imath passenger cars (hereinafter “maM5”), the instant passenger cars and J QM5 passenger cars (hereinafter “ QM5”), were going through a series of years, and QM5 passenger cars (hereinafter “ QM5”), and as the Plaintiff stopped the instant passenger car, QM5 received the instant passenger car, and QM5 followed the instant passenger car. F. The Defendant stopped the Defendant’s towing vehicle on the two-lanes of the opposite direction that the instant vehicle stopped (hereinafter “the opposite direction road”), among the two-lane roads where the instant vehicle stopped, and all the group driven a marina and stopped following the Defendant’s towing.
The defendant around 21:20 on June 13, 2016 connects the automobile of this case to be towed by the defendant.
