1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. On March 2016, the Plaintiff found the Defendant who was engaged in advertising advertising operations at the end of the year, and proposed that “I would like to pay more than four money if I would like to make I’s daily atmosphere and post- World Experience as a film. I would like to create a film.” After the discussion, I would like to produce the Plaintiff’s story as a film.

B. The Plaintiff made a motion picture investment proposal to the Defendant, and accordingly, the investment proposal produced by the Defendant was written with the budget of motion pictures to be produced in the future (hereinafter “instant motion pictures”) of KRW 4 billion (1 billion in net production cost of KRW 3 billion in promotional marketing cost of KRW 1 billion).

C. While the Plaintiff and the Defendant were also aware of investors, the Plaintiff and the Defendant identified D, the head of the Daegu Branch of Investment Company C, or whether the investment related to the production of film is possible. The said D reviewed the investment proposal and rejected the investment after having talked with the Plaintiff and the Defendant.

On April 8, 2018, the Plaintiff found E, who had resided with the Defendant in a sacrife with the Defendant, produced the Plaintiff’s story to E, and due to the lack of cost, E lent KRW 100 million to the Defendant, and the Plaintiff paid KRW 20 million on April 8, 2016, and KRW 80 million on April 15, 201.

E. On April 2018, the Defendant leased 15 million won as lease deposit, monthly rent of KRW 750,000, and lease period from April 13, 2016 to April 12, 2018, the office of 15 million in the vicinity of the Plaintiff’s residence was transferred to a new work room while arranging the advertisement production work already operated.

F. The Defendant, from the beginning of May 2018, went through an interview with the Plaintiff and engaged in collecting data, etc., for the same year.

5. A film production is suspended as it is no longer possible to complete a film with an investment from a third party, and part of the film production process is to produce documentary records against the Plaintiff, whose money is less than anything else.
