A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On March 18, 2015, the Defendant committed the crime of March 18, 2015 (Crimes related to the production of motion pictures “B”) made “B” to the victim C, “A motion picture - to be funded by 2 years of age, such as D,” instead of E, and indirectly advertised “F” operated through motion pictures. At present, the Defendant made a false statement to the effect that “A motion picture screen is needed to be 20 million won to be reduced to G in motion pictures.”

However, on December 2012, the Defendant: (a) had been granted KRW 20 million to I, but did not proceed with the production of a film; (b) the scenario was not determined even around March 2015; (c) not only did the investors secure but also did it use the money received from the victim for the Defendant’s living expenses, etc.; (d) even if he/she received money from the victim under the pretext of giving the victim’s contribution to the film, he/she did not have any intent or ability to give the “F” in the film.

Around March 18, 2015, the Defendant, by deceiving the victim, received KRW 20 million from the victim's office located in the Jung-gu Seoul Metropolitan GovernmentJ as the compensation for film contribution and indirect advertising.

2. From August 20, 2015 to December 28, 2015 (Crimes related to the Production of Motion Pictures “K”) Defendant refused to provide “B” production assistance to the victim, i.e., under the name of the victim and the investors around August 2015.

To make an independent film of the budget with the nature of a material with the subject of width prior to initiating “B”, the title is K, which may always be awarded if it is displayed on the German film festivals, Japanese U2S film festivals, and Busan International film festivals;
