A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

During the period from November 26, 2014 to November 22, 2017, the Defendant was engaged in managing the property of a clan as the chairperson of a family during the period from November 26, 2014.

On November 2016, the Defendant forged the minutes as if there was a resolution of the general meeting to sell C23 square meters and D 157 square meters in Namyang-si, which is the property of a clan, and had sold the said real estate at will and had the intention to use the proceeds for personal use.

1. On November 2016, the Defendant: (a) made a decision to sell and purchase private document counterfeit and D two parcels of land in total at KRW 100 million using a computer at an insular site using the computer; (b) made a minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the minutes of the meeting of the Plaintiff, and affixed a seal affixed to the seals of E, F, G, and H, in which the names of E, G, and H were recorded in advance and kept.

Accordingly, the defendant, for the purpose of uttering, forged the minutes of a clan in the name of E, F, G, and H, a private document on proof of facts.

2. Around November 2016, the Defendant entered into a sales contract with I as to the land specified in paragraph 1 (1) at an unspecified land, and exercised the following: (a) as if the forged minutes were duly formed as prescribed in paragraph 1 (a), the Defendant sent it to I without knowledge of the fact that the recorded minutes were duly formed.

3. The Defendant, as the president of the victim B, kept the said real estate on behalf of the victim. On November 2016, the minutes were forged and sold the said real estate to I at KRW 150 million after forging the minutes as set forth in paragraph 1.

Accordingly, the Defendant embezzled the above real estate owned by the victim clan.
