1. The part concerning the conjunctive claim in the judgment of the first instance shall be revoked;
2. The Defendant limited to the Plaintiff on June 19, 2013.
Reasons
1. Details of the disposition;
A. The Plaintiff was elected as the Defendant’s proportional representative member in the election of the member of the fifth local council, which was implemented on June 2, 2010.
B. On May 3, 2013, Nonparty C, who is in office as a member of the Gyeonggi-do Council, filed a complaint against the Plaintiff on the charge of defamation. The gist of the complaint is as follows.
Although the above C did not have any factually inappropriate relationship with the operator of the “D” restaurant, the Plaintiff is deemed to be a member of the Defendant’s Council at the planning and administrative committee office around 11:00 on April 23, 2013, Nonparty E (hereinafter referred to as the “member of the Defendant”) who is the cause of the Defendant’s affiliation within the office of the planning and administrative committee office of B City Council.
(3) At around 11:30 the following day, Nonparty F and G Council members made false statements to the effect that “C Do Council members have been aware of the fact that they had been traveling in Jeju-do for three months prior to the D cafeteria, and that they had been aware of the fact that they had taken the site pictures,” and around 11:30 the following day, Nonparty F and G Council members made false statements to the same effect, and around 13:00 on the 26th day of the same month, approximately 40 Council members including the above G, including the above G, are in an inappropriate relationship with G Council members, after re-verification of the fact that “C Do Council members had been traveling in Jeju-do for three months prior to the D cafeteria, and that they had made false statements to the effect that they had been aware of the fact that they had been traveling in Jeju-do.” In relation to the above accusation, the members made a request for disciplinary action against the Plaintiff et al., al., to the effect that they had damaged their dignity.
