1. The plaintiff's lawsuit against defendant Han Il Construction Co., Ltd. shall be dismissed.

1. Basic facts

A. On January 11, 2008, the Seoul Metropolitan Government announced a bid for the construction project of the Seoul Metropolitan Government and made the Plaintiff’s consensus 1) land of the size of 37,280 square meters in size of 0 square meters in f block 2,00 square meters in the digital media city site development zone in the area of the commercial ambacheon-dong, Mapo-gu, Seoul Metropolitan Government (hereinafter “instant building site”).

(B) the project for the development, construction, sale and operation of the digital media exhibition and the Grandmark building representing Seoul Special Metropolitan City (hereinafter referred to as the “instant project”).

(2) On April 29, 2008, the Plaintiff announced the bidding of the Defendants and Non-Party Construction Co., Ltd. (hereinafter referred to as the “Defendant and Non-Party Co., Ltd.”), Gyeongnam Co., Ltd., Dong-nam Co., Ltd., 3-Exchange Co., Ltd., and Ornb Co., Ltd. (hereinafter referred to as the “Defendant and Non-Party Co., Ltd.”) to invite the bidding for the instant project between the Defendants and Non-Party Co., Ltd. (hereinafter referred to as the “Co., Ltd.”), and to establish a special purpose corporation after being selected as a business operator, to carry out the project. The Plaintiff concluded the “Basic Convention on the PF Services in Building in Daam-dong Dommark Co., Ltd.” (hereinafter referred to as the “instant Framework Convention”) and constituted the Seoul Grandmark Consortium (hereinafter referred to as the “instant Consorium”).

Article 1 (Purpose and Party) (1) The objective of this Convention is to determine the necessary basic matters between the parties in relation to the formation of a consortium and the implementation of the instant project in order to jointly participate in the public invitation of private business operators of the instant project in accordance with the Guidelines for Land Supply of Grandmark Building announced by Seoul Special Metropolitan City on January 11, 2008.

(2) The following investors shall form the consortium in accordance with the Framework Convention for the purpose of participating in the public offering of operators of the instant business and carrying out the instant business.
