A defendant shall be punished by imprisonment for not more than ten months and by a fine not exceeding 500,000 won.

When the defendant does not pay the above fine.

Punishment of the crime

Despite the fact that the Defendant is not a person handling narcotics, the Defendant dealt with the psychotropic drugs, such as the following:

1. From July 2019 to 22:00 to 24:00, the Defendant: (a) remitted the 1,000 bill (an amount equivalent to KRW 1.70,000 to “B”) to a seller of a penphone in China; and (b) purchased a penphone by receiving approximately 0.5 g of a mobile phone under the back 0.5 g of a mobile phone under the back gate of a number-free vehicle on which a non-residential house in Bupyeong-si is parked in B.

2. At around 06:00 to 07:00 on August 4, 2019, the Defendant administered philophones in a manner that puts the philophones volume ( approximately 0.01 to 0.02 g) above the gambling place at the Defendant’s residence located in Ansan-si, a member of Ansan-si, on the part of the Defendant’s household, and puts the philophones volume ( approximately 0.01 to 0.02 g) on the philophones.

3. At around 11:50 on August 5, 2019, the Defendant: (a) inserted 0.35g of philopon in the Defendant’s residence located in Ansan-si member D; (b) stored 0.35g of philopon in a transparent plastic packing box; and (c) carried philopon in a transparent plastic bag.

4. A foreigner who has filed for registration to stay in Korea in violation of the Immigration Control Act shall file a move-in report with the head of a Si/Gun/Gu or Eup/Myeon/Dong of a new place of stay or the head of a Regional Immigration Service having jurisdiction over such place of stay within 14 days from the date of transfer.

Nevertheless, the Defendant did not make a move-in report until August 5, 2019, even though he/she changed his/her place of stay to the member-gu Ftel G in Ansan-si, Ansan-si, Ansan-si.
