1. Basic facts

A. (1) The Plaintiff mobilization industry corporation completed the registration of ownership transfer on February 19, 2004 with respect to the portion of 330/3,846 square meters of land E, Jung-gu, Seongbuk-gu, Sungnam-gu (hereinafter “E land”); and the Plaintiff Appnbnb Co., Ltd.’s mobilization for the Plaintiff completed the registration of ownership transfer on February 21, 2003 with respect to the portion of 3,516/3,846 of the above land.

(2) Defendant B completed the registration of ownership transfer on June 10, 1989 with respect to D forest land 2,158 square meters (hereinafter “D land”) in Seongdong-gu, Sungnam-gu, Sungnam-gu. Defendant B completed the registration of ownership transfer on September 12, 2007 with respect to the share of 59.6/2,158 out of the said land.

(b)According to the forestry map (the land of this case) and the forestry map (the land of this case) prepared under the shipbuilding and Forestry Order in the Japanese colonial era (1) the forestry map (the scale: 1/600; D land constitutes a part of the G forest in the Jung-gu, Sungnam-gu, Sungnam-gu, the lot number before subdivision; E land is a part of the H forest in the land of this case, the lot number and the land category at the time of the preparation of the said forestry map, and of the land of this case, the land of this case is a part of the H forest in the Jung-gu, Sungnam-gu, and the I forest and the J site and the K site), the boundary of each land of this case is the line connected in sequence with each of the items in the annexed drawing Nos. 1, 2, and 3. The boundary of the land of the land of this case is not overlapping

(2) However, according to the Jeju Housing Construction Project implemented in Sungnam-si around 1973, the said H forests and I forests were created as a housing site in the process of changing the parcel number and land category into the said J sites and K sites, and were determined and publicly announced as an industrial area in 1974, and a cadastral map (scale: 1/600) as to the land for a factory was re-established on July 1974. According to the cadastral map, the boundary of each land of this case is a line successively connected with each of the points indicated in the annexed map No. 1,17, and 16, and the same scale as the above cadastral map and the forestry map is prepared.
