1. The plaintiff's primary claim and the conjunctive claim are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On December 16, 2008, C Co., Ltd. (hereinafter “C”) concluded an insurance contract in attached Form 1 (hereinafter “instant insurance contract”) with the Defendant and the insured as the Defendant and secured general injury, temporary living expenses, hospitalization expenses, etc.
B. On May 3, 2013, the Plaintiff is an insurer that acquired various insurance contracts, including the instant insurance contracts, from C through a decision to transfer contracts by the Financial Services Commission.
C. The Defendant: (a) hospitalized 317 days in total over 24 times as indicated below for the treatment of catitis, etc. from March 21, 2009 to December 6, 2016, which was after the conclusion of the instant insurance contract; (b) received KRW 38,029,977 from the Plaintiff on the ground of the said insurance accident, etc.
