Attached Form 1: The remaining amount after deducting the expenses for auction from the proceeds from the sale shall be put to an auction.
Reasons
1. Comprehensively taking account of the overall purport of the arguments in Gap evidence Nos. 1 and 6 as to the cause of the claim, it is reasonable to divide the real estate as shown in the attached Table 1 into co-ownership ratio as shown in the attached Table 2, and it is not reasonable to divide the real estate in kind with a blind land. The defendants can recognize the plaintiff's auction division claim that there is no objection other than the time and condition. Thus, it is reasonable to divide the real estate into co-ownership by auction division.
2. In conclusion, the real estate listed in the separate sheet 1 shall be sold at auction and the remaining amount after deducting the auction cost from the proceeds of the sale shall be distributed according to the corresponding share ratio of the plaintiff and the defendants as stated in the separate sheet 2.
