1. Basic facts

A. The instant apartment is constructed as a housing construction project under the Housing Act.

B. The plaintiff is the owner of the apartment of this case. On May 23, 2006, the plaintiff entered into a lease agreement with the defendant on the apartment of this case (hereinafter "the lease agreement of this case") with the following contents, and the defendant occupied the apartment of this case on August 1, 2009 when the occupancy designation period expires.
