Defendant shall be punished by a fine of KRW 10 million.

If the defendant fails to pay the above fine, one hundred thousand won shall be one day.

Punishment of the crime

[Criminal Power] On July 23, 2013, the Defendant was issued a summary order of KRW 2 million by the Seoul Central District Court for the crime of violation of the Road Traffic Act.

【Criminal Facts】

1. The accused is a person who is engaged in driving a B motorcycle;

On February 17, 2020, the Defendant driven the above motorcycle while under the influence of alcohol of 0.045% of blood alcohol concentration around 20:15, and driven the above motorcycle in the direction of E apartment from the upper side of the D Hospital located in Dongjak-gu Seoul Metropolitan Government on the street.

Since the place is where the center line of yellow ray is installed, the driver has a duty of care to thoroughly operate the front line and safely in the maintenance of the tea line.

Nevertheless, while the Defendant neglected to do so, while driving a motor bicycle in parallel with the center line of the yellow point line, the victim G (the 32 years of age and South) who drives the Fmotor bicycle in line with the direction of the above lane is trying to avoid an accident with the motor bicycle of the Defendant, and the two sides of the Defendant's motorcycle and the victim's motorcycle conflict with the victim's motorcycle.

As above, the Defendant driven the above motorcycle in a state where normal driving is difficult due to influence of drinking, and suffered injury to the victim, such as climatic salt, which requires a stable price for about 20 days.

The Defendant violated the Road Traffic Act (driving) at the time and time set forth in paragraph (1) of this Article, driving the above motorcycle while under the influence of alcohol 0.045% at approximately 100 meters from the front of Dongjak-gu Seoul Metropolitan Government H on the road to the place where the said accident occurred, thereby violating the provision prohibiting driving under the influence of alcohol more than twice.
