Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is a child care teacher of the C Child Care Center B located in Goyang-dong, Busan Metropolitan City, and the child victim D (ma, 3 years of age) is the child care teacher of the above child care center.

1. On October 18, 2019, the Defendant: (a) committed physical abuse, on the ground that the above victimized child does not listen to his/her speech within the class of the child-care center (hereinafter referred to as the “child-care center”) and on the ground that he/she does not sleep and do not listen to his/her speech; (b) at one time, he/she committed a physical abuse that may injure the child’s body, health, and development; and

2. 피고인은 2019. 11. 22. 13:17경 위 어린이집 교실 내에서 위와 같은 이유로 피해아동의 몸을 양팔로 세게 밀치고 피해아동의 양팔을 잡아들어 올린 후 바닥에 내팽개치고, 피해아동을 구석에 앉혀 놓고 턱을 툭툭 때리고 꿀밤을 한대 때리고, 발로 피해아동을 구석으로 몰아넣듯 차는 행위를 하여 아동의 신체에 손상을 주거나 신체의 건강 및 발달을 해치는 신체적 학대행위를 하였다.

3. On December 2, 2019, the Defendant: (a) around December 13:13, 2019, committed physical abuse, i.e., when she satisfies the chest of the victimized child; (b) satisfs the two arms of the victimized child; and (c) when satisfs the face of the victimized child due to his/her fingers, thereby damaging the child’s body or undermining the health and development of the body.

4. On December 18, 2019, the Defendant committed physical abuse against the victim’s body or undermining physical health and development of the body by putting the head of the victimized child one time at the hands of the victimized child’s head, and by putting the head of the victimized child in good hands, on the hand, within the class of the above child-care center, around December 12:58.
